RETURNS, REFUNDS & EXCHANGES POLICY

Last updated: 28 August 2026

At Huzara (“Huzara”, “we”, “us” or “our”), we want you to be satisfied with your purchase. This Returns, Refunds & Exchanges Policy applies to purchases of our Dhikr Rings and related products made through our online store.

This policy is governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), and other applicable South African legislation.

Nothing in this policy is intended to exclude, restrict or waive any right that you may have under South African law where such exclusion, restriction or waiver is prohibited.

1. CHANGE-OF-MIND RETURNS

Subject to the statutory rights described elsewhere in this policy, we do not offer a general “change-of-mind” return policy beyond what South African law requires.

This means that, outside of a statutory cooling-off right or where the product is defective, unsafe, not of the required quality, or otherwise does not comply with applicable consumer protection legislation, we are not obliged to accept a return simply because:

  • you changed your mind;

  • you no longer want the product;

  • you ordered the wrong size;

  • you ordered the wrong colour or style;

  • the product does not match your personal preference;

  • you found the product cheaper elsewhere;

  • you purchased the product as a gift and the recipient does not want it; or

  • you ordered an incorrect product through your own error.

Where we voluntarily agree to accept a change-of-mind return, we may impose reasonable conditions communicated to you before the return is approved, including that the product is unused, undamaged and returned with all original accessories and packaging.

2. ONLINE PURCHASES AND THE COOLING-OFF RIGHT

Where a purchase qualifies for a statutory cooling-off right under ECTA, you may cancel the transaction within the applicable statutory period without giving a reason and without a penalty, subject to the provisions and exceptions contained in applicable legislation.

For qualifying electronic transactions, ECTA provides a seven-day cooling-off period calculated from receipt of the goods.

If you exercise a statutory cooling-off right:

  1. you must notify us within the applicable statutory period;

  2. the product must be returned to us as required by law;

  3. you may be responsible for the direct cost of returning the product where permitted by law; and

  4. any refund will be processed in accordance with the applicable statutory requirements.

This section does not limit any other rights you may have under the CPA or any other applicable law.

3. DEFECTIVE, DAMAGED OR FAULTY PRODUCTS

We stand behind the quality of our Dhikr Rings.

If your Dhikr Ring is defective, unsafe, of unacceptable quality, not reasonably durable, or otherwise fails to meet the standards required by applicable consumer protection legislation, please contact us as soon as reasonably possible.

Under the CPA, qualifying goods carry an implied warranty of quality. Subject to the requirements of the CPA, a consumer may return qualifying defective goods within six months after delivery, without penalty and at the supplier's risk and expense.

Where the CPA applies, the consumer's statutory remedies will apply, including the applicable right to choose between repair, replacement or refund where provided by the Act.

We may request reasonable information, photographs or videos to help us identify the reported problem and may inspect or test the product where reasonably necessary.

Nothing in this policy removes or limits your statutory rights.

4. DAMAGE CAUSED AFTER DELIVERY

Our responsibility for defects or failures does not extend to damage caused by misuse, abuse, neglect, accidental damage, unauthorised modification, improper care, failure to follow product instructions, or other damage caused after the product has left our control, to the extent permitted by law.

Examples may include:

  • dropping or crushing the ring;

  • intentionally damaging the ring;

  • attempting to repair or modify the ring yourself;

  • exposing the ring to substances or conditions for which it was not designed;

  • using the ring contrary to the instructions supplied with the product;

  • damage caused by excessive force or impact;

  • normal cosmetic wear and tear that does not amount to a defect; or

  • damage resulting from improper storage or use.

Nothing in this section limits liability that cannot lawfully be excluded or limited.

5. WATER, MOISTURE AND ELECTRONIC COMPONENTS

Where a Dhikr Ring is described as water-resistant, splash-resistant or otherwise resistant to moisture, this does not necessarily mean that the ring is waterproof or suitable for prolonged immersion.

Unless the specific product description expressly states otherwise, you should avoid:

  • swimming while wearing the ring;

  • bathing or showering with the ring;

  • prolonged immersion in water;

  • exposing the ring to high-pressure water;

  • exposing the ring to steam or extreme humidity;

  • using the ring in a manner inconsistent with its product instructions.

Damage resulting from water or moisture exposure outside the product's stated specifications may not constitute a manufacturing defect.

6. BATTERY AND NORMAL WEAR

Dhikr Rings containing rechargeable batteries or electronic components may experience normal battery degradation over time.

A gradual reduction in battery capacity resulting from ordinary use does not automatically constitute a defect.

However, nothing in this section limits your statutory rights where the product fails to comply with the quality, durability or other requirements imposed by applicable South African law.

7. INCORRECT, INCOMPLETE OR MIS-DESCRIBED ORDERS

If we send you:

  • the wrong product;

  • the wrong size;

  • the wrong colour or variant;

  • a product materially different from the product you ordered; or

  • an order missing an item,

please contact us as soon as reasonably possible after receiving your order.

We will investigate the issue and, where we are responsible for the error, provide the appropriate remedy in accordance with applicable law.

Where we have supplied the wrong product, we may arrange collection or provide reasonable instructions for returning the incorrect item.

8. PRODUCTS DAMAGED DURING DELIVERY

Please inspect your parcel and product as soon as reasonably practical after delivery.

If your order appears to have been damaged during transportation, please contact us promptly and provide:

  • your order number;

  • photographs of the packaging;

  • photographs of the damaged product; and

  • a brief description of the damage.

Please retain the original packaging until the matter has been resolved, where reasonably possible.

Nothing in this section limits any statutory rights you may have.

9. HYGIENE AND PERSONAL USE

Dhikr Rings are personal-use products.

Where permitted by law, we may refuse a voluntary change-of-mind return where a product has been used or where accepting the returned product would create legitimate hygiene, health or safety concerns.

This restriction does not apply to a statutory return or remedy that cannot lawfully be excluded.

10. RETURNS MUST BE AUTHORISED

Except where otherwise required by law, please do not send products to us without first contacting us.

To request a return, contact us through the customer service details provided on our website and include:

  • your full name;

  • order number;

  • date of purchase;

  • product purchased;

  • reason for the return; and

  • photographs or videos where relevant.

We will provide return instructions where the return is accepted.

We reserve the right to verify the purchase and inspect returned products before processing a voluntary return or determining the appropriate remedy, subject always to applicable consumer rights.

11. CONDITION OF RETURNED PRODUCTS

Where a return is being made under a voluntary return policy rather than a statutory right, we may require that the product:

  • is unused;

  • is in substantially the same condition in which it was supplied;

  • includes all accessories supplied with the product;

  • includes the original packaging where reasonably possible; and

  • has not been intentionally damaged, modified or tampered with.

These conditions do not override statutory rights relating to defective, unsafe or non-compliant goods.

12. RETURN SHIPPING COSTS

Where a return is required because:

  • we supplied the wrong product;

  • the product was damaged before or during delivery for which we are responsible; or

  • the product is defective or otherwise qualifies for a statutory remedy,

we will handle return shipping in accordance with our obligations under applicable law.

For a voluntary return that is not required by law, the customer may be responsible for the direct cost of returning the product.

Where ECTA's cooling-off provisions apply, the consumer may be responsible for the direct cost of returning the goods, as provided by the legislation.

13. REFUNDS

Where you are legally entitled to a refund, we will process the refund in accordance with applicable South African law.

Refunds will generally be made using the original payment method where reasonably possible.

Depending on your payment provider, bank or payment processor, the time for the refunded amount to appear in your account may vary.

We are not responsible for delays caused solely by a bank, payment gateway or other third-party payment provider after we have initiated the refund.

Where a refund is not legally required and we voluntarily agree to provide one, any applicable conditions will be communicated to you before the refund is processed.

14. EXCHANGES

Where permitted by law, we may offer an exchange instead of a refund for voluntary returns.

An exchange is subject to product availability.

Where a product is defective or otherwise qualifies for a statutory remedy, your rights under applicable law will apply and we will not use this exchange provision to remove or restrict those rights.

15. SALE, DISCOUNTED AND PROMOTIONAL PRODUCTS

Products purchased during sales, promotions or special offers remain subject to all applicable statutory consumer rights.

A discount or promotional price does not remove a consumer's rights in respect of defective, unsafe, poor-quality or otherwise non-compliant goods.

Where a product is sold in a specific condition and the consumer has been clearly informed of that condition and has expressly agreed to accept it, the applicable statutory rules relating to goods supplied in that condition will apply.

16. GIFTS

If a product was purchased as a gift, the rights under this policy and applicable law generally attach to the transaction and purchaser.

Refunds may therefore be made to the original purchaser or original payment method where appropriate.

Where legally permitted, we may require the original purchaser's involvement before processing a refund.

17. FRAUDULENT OR ABUSIVE RETURN REQUESTS

We reserve the right to investigate suspected fraudulent, dishonest or abusive return activity.

This may include situations where a customer:

  • submits false information;

  • returns a different product from the one purchased;

  • intentionally damages a product;

  • attempts to obtain repeated unjustified refunds;

  • provides materially misleading information about a product defect; or

  • engages in conduct intended to abuse the return or refund process.

Nothing in this clause permits us to refuse a remedy that is legally required under South African law.

18. NO WAIVER OF STATUTORY RIGHTS

Nothing in this policy:

  • excludes any consumer right that cannot legally be excluded;

  • limits any remedy available to a consumer under the CPA;

  • limits any right available under ECTA;

  • excludes liability where exclusion is prohibited by law; or

  • prevents a consumer from exercising any right provided by applicable South African legislation.

If any provision of this policy conflicts with a mandatory provision of South African law, the applicable law will prevail and the remaining provisions will continue to apply to the extent legally permissible.

19. OUR LIABILITY

To the maximum extent permitted by South African law, we will not be liable for losses that are not reasonably attributable to our breach of contract, negligence or another legally recognised basis of liability.

Nothing in this policy excludes or limits liability that South African law does not permit us to exclude or limit.

In particular, nothing in this policy is intended to exclude liability for matters that cannot lawfully be excluded under the CPA or other applicable legislation.

20. HOW TO CONTACT US

To request a return, report a defective product or raise a refund issue, please contact us using the customer service contact details published on our website.

Please include your order number so that we can locate your purchase and assist you as quickly as possible.

21. GOVERNING LAW

This policy and transactions to which it applies are governed by the laws of the Republic of South Africa, subject to any mandatory consumer protection rights applicable to the transaction.

Nothing in this clause prevents a consumer from exercising rights or remedies available under applicable South African consumer protection legislation.

IMPORTANT

This Returns, Refunds & Exchanges Policy should be read together with our Terms & Conditions, Privacy Policy, Shipping Policy and any product-specific terms or instructions published on our website.

Where applicable South African legislation gives a consumer a right that differs from this policy, the applicable legislation will prevail.

Huzara reserves the right to update this policy from time to time. The version applicable to a transaction will be determined in accordance with applicable law.
